This consolidated advice concerns the current position of environment and planning law in New South Wales with respect to the use of premises as brothels. It provides an analysis of relevant provisions of the Environmental Planning and Assessment Act 1979 (NSW) ("EPA Act"), environmental planning instruments created under that Act, the Disorderly Houses Act 1943 (NSW) ("DH Act"), and decisions of the Land and Environment Court ("LEC") and Court of Appeal.
